WB Police jobs: ‘Candidacy for Hijab-wearing photo canceled’, appointment in police will depend on verdict: court

The candidature for the photo wearing hijab in the application form was ‘canceled’. Some Muslim candidates had filed a case in the Calcutta High Court. In that case, the High Court on Monday said that a West Bengal police constable would be appointed on the basis of the case filed. In other words, the outcome of the recruitment process of the West Bengal Police will have to comply with the directions of the relevant writ petition.

The preliminary examination for the post of constable of West Bengal Police was held on 26 September. That is why the admit card was issued in early September. Allegedly, the candidacy of about 1,000 Muslim women was disqualified for posing for a hijab. Some candidates filed a case in the High Court.

According to the rules of West Bengal Recruitment Board (2020), the face of the candidate in the picture cannot be covered in any way. There is also a ban on taking pictures with sunglasses covering the face or head. However, the plaintiffs claimed that there was no such rule in the guidelines of the West Bengal Recruitment Board (2019). The rules contained in the new guidelines are in violation of the fundamental rights enshrined in Article 25 of the Constitution.

In the wake of that case, Justice Arindam Mukherjee said, “In the preliminary hearing, it seems to me that the matter can be settled without any affidavit as there is no contentious issue involved.” He also said that the outcome of the West Bengal Police recruitment process would have to comply with the directions of the concerned writ petition. The next hearing of the case is scheduled for January 7 next year.
